Terms of Use — Boombree

These Terms of Use (“Terms”) are an agreement between you and Intellectero Solutions QFZ LLC (“Intellectero”, “we”, “us”) governing your use of the Boombree application and website (together, “the App”). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

Important safety notice. Boombree is an assistive convenience tool. It is not a medical device, life-safety device, or a substitute for direct adult supervision. Its detections and alerts may be delayed, missed, or triggered incorrectly, and depend on your phones, batteries, permissions and network. Never rely on Boombree as the sole means of supervising a child. Always follow safe-sleep guidance and keep a child in your care properly supervised.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own household's non-commercial use, in accordance with these Terms and any applicable app-store terms.

2. Boombree is not a safety or medical device

The App uses a phone camera, microphone and heuristic/AI detection to provide alerts. Detection is inherently imperfect. Events may not be detected, may be detected late, or false alerts may occur. Video or audio may be interrupted by battery, device, permission, network, operating-system or other conditions outside our control. You acknowledge that Boombree is a supplementary aid only and must not be used as a primary or sole means of monitoring, nor for any situation where failure could lead to harm.

3. Acceptable use

Use the App only to monitor a child in your care or another person who has consented to being monitored.
Do not use the App to record, surveil, harass or invade the privacy of any person without their knowledge and consent, or in any way that is unlawful.
Do not misuse, interfere with, reverse engineer (except as permitted by law), or attempt to disrupt the App or its supporting infrastructure.

You are solely responsible for ensuring your use complies with all laws that apply to you, including privacy and recording laws.

4. Your responsibilities

Provide compatible, working phones with sufficient battery/charging, and grant the required permissions.
Maintain a reliable network connection appropriate to the mode you use.
Test the setup before relying on it, and keep the child properly supervised at all times.

5. No accounts & service availability

Boombree does not require an account. Remote mode depends on connection infrastructure we operate, which may be modified, interrupted or discontinued at any time without notice. We do not guarantee that the App or any feature will be available, uninterrupted, or error-free.

6. Intellectual property

The App, including its name, logo, design, and software, is owned by Intellectero and protected by applicable laws. These Terms do not grant you any rights in our trademarks or content except the limited license above.

7. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL DETECT ANY PARTICULAR EVENT OR THAT ALERTS WILL BE TIMELY OR DELIVERED.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL INTELLECTERO OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON THE APP OR ANY MISSED, DELAYED OR INCORRECT ALERT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

9. Indemnification

You agree to indemnify and hold harmless Intellectero from any claims, damages or expenses arising out of your use of the App or your violation of these Terms or applicable law.

10. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access to the App or its infrastructure if you breach these Terms or where necessary to protect the service.

11. Governing law

These Terms are governed by the laws applicable at the place of business of Intellectero, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date above reflects the latest version.
